The operational agreements governing our work together.

These Terms of Service ("Terms") constitute a legally binding agreement between Synergy Solutions ("we," "us," or "our") and the client ("you" or "your"). By accepting a quotation, paying a deposit, or authorizing us to commence work across any of our divisions (Airconditioning, Solar, or Workforce Staffing), you agree to be bound by the terms set out below.

1. Quotations and Pricing

  • Validity: Quotations are valid for a period of thirty (30) days from the date of issue, unless otherwise specified in writing.
  • Unforeseen Site Conditions: Quotations for solar and air conditioning installations are based on a visual inspection. Should our technicians discover hidden structural, roofing, or legacy electrical defects during installation, necessary remedial work will be quoted for separately.
  • Exchange Rates: Due to the imported nature of high-end solar and inverter hardware, specific hardware quotes are subject to major currency fluctuations prior to deposit clearance.

2. Climate Control & Solar (Installation Terms)

  • Site Access: You must grant our technicians free, unimpeded, and safe access to the property during agreed working hours, as well as standard access to water and electricity required to execute the job.
  • Municipal & Landlord Approvals: You are strictly responsible for obtaining all necessary Body Corporate permissions, landlord consents, heritage clearances, or municipal Small-Scale Embedded Generation (SSEG) registrations required for solar arrays. Synergy Solutions takes no responsibility for municipal fines or forced removals resulting from unapproved property modifications.
  • Retention of Title: All supplied hardware, solar panels, inverters, batteries, and HVAC units remain the absolute property of Synergy Solutions until the final invoice has been settled in full. We reserve the legal right to disconnect and remove unpaid machinery.
  • Certificates of Compliance (CoC): Electrical CoCs for solar installations will only be released upon 100% final invoice settlement.

3. Workforce Staffing (Labour Terms)

  • Capacity: Synergy Solutions operates as a Temporary Employment Service (TES) in accordance with the Labour Relations Act (LRA) of South Africa. Placed candidates remain our assignees during the contracted temporary period.
  • Workplace Safety: While assigned to your premises, you carry the strict legal obligation to ensure a safe working environment in full compliance with the Occupational Health and Safety Act (OHSA). You must provide specialized personal protective equipment (PPE) required for your specific operational hazards, unless explicitly agreed otherwise in our SLA.
  • Supervision: Placed temporary staff work under your direct operational control and daily supervision. Synergy Solutions is not liable for operational errors, stock wastage, or damages caused by temporary personnel while executing your floor directives.
  • Permanent Placement Fees: Should you decide to permanently employ a Synergy temporary assignee within six (6) months of their placement, a standard placement conversion fee will apply as outlined in our recruitment schedule.

4. Warranties and Liabilities

  • Workmanship Guarantee: We provide a standard twelve (12) month guarantee on physical installation workmanship (piping, mounting, and wiring).
  • Manufacturer Warranties: Supplied hardware (Daikin, Sunsynk, Deye, LG, etc.) carries the original manufacturer’s warranty. Warranty claims are subject to the manufacturer's inspection and terms (e.g., voided by third-party tampering or severe grid-power surges).
  • Limitation of Liability: Synergy Solutions shall not be held liable for pre-existing roof leaks, legacy wiring failures, or indirect, consequential damages (including loss of profits or business interruption) arising from an installation or temporary staff shortage.

5. Cancellations and Delays

  • Weather Delays: Working on rooftops with high-voltage solar equipment is strictly weather-dependent. Synergy reserves the right to postpone installations due to rain, high winds, or lightning without financial penalty.
  • Postponements: If you cancel or postpone an agreed installation or staff deployment with less than 24 hours' notice, a standard site-callout or administration fee will be billed.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any legal disputes arising from these terms shall be subject to the jurisdiction of the South African courts.
